Terms of Service

The rules and agreements that govern your use of OARealm — please read them carefully.

1. Acceptance of terms

These Terms of Service ("Terms") form a binding agreement between you and OARealm LLC ("OARealm," "we," "us," or "our") governing your access to and use of the OARealm website, mobile applications, and related services (collectively, the "Service").

By creating an account, browsing the Service, or otherwise using it, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility and accounts

You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@oarealm.com if you suspect unauthorized use of your account.

3. User content and ownership

You retain all ownership rights to the artwork, images, descriptions, and other content you upload to OARealm ("User Content"). We do not claim ownership over your User Content.

By uploading User Content, you grant OARealm a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that content solely for the purpose of operating, promoting, and improving the Service — for example, displaying your artwork on your public profile, in galleries, and in search results.

You represent and warrant that you own or have the necessary rights to the User Content you upload, and that it does not infringe any third party’s intellectual property or other rights.

4. Marketplace and transactions

Where enabled, OARealm allows artists to list original art and prints for sale to collectors ("Marketplace"). OARealm LLC is an online venue connecting buyers and sellers; it is not an auctioneer, art appraiser, or direct seller of third-party art, and does not take title to any item listed on the Marketplace.

By listing an item, the seller warrants full legal ownership of the artwork, the accuracy of its condition and description, and that it is an authentic original (or, where explicitly disclosed, an authorized print or reproduction). Sellers are responsible for honoring listed prices and fulfilling orders in a timely manner; buyers are responsible for reviewing listings carefully before purchasing.

OARealm may charge service or transaction fees for Marketplace activity, which will be disclosed prior to purchase. Payment processing, chargebacks, and merchant disputes for Marketplace transactions are administered directly through our designated third-party payment processor and the seller’s connected merchant account, subject to that processor’s own terms.

To the fullest extent permitted by law, OARealm’s total liability arising out of or relating to any single Marketplace transaction is limited to the platform commission fee actually received by OARealm for that transaction.

Sellers shipping physical artwork through the Marketplace must package it to withstand transit — rigid backing (e.g., mylar plus heavy cardboard) for works on paper is required — and must ship with tracking and signature confirmation for any item valued over $500.

5. Prohibited conduct

You agree not to: upload content you do not have the right to share; infringe another person’s copyright, trademark, or other intellectual property rights; harass, impersonate, or defame other users; upload malicious code; scrape or bulk-collect data from the Service without permission; or use the Service for any unlawful purpose.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, at our sole discretion.

6. Copyright and DMCA

OARealm respects the intellectual property rights of others. If you believe content on the Service infringes your copyright, please see our DMCA Notice & Takedown Policy for instructions on submitting a takedown request to dmca@oarealm.com.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. OARealm does not guarantee that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, OARealm LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

8. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion, with or without notice.

9. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the state in which OARealm LLC is organized, without regard to its conflict-of-laws principles, except where superseded by applicable local law.
